1. Agreement to these terms

These Terms of Service (“Terms”) govern your use of www.campagnebrand.com (the “Site”) and purchases from Campagne (“Campagne,” “we,” “us,” or “our”). By using the Site or placing an order, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site or place an order.

2. Eligibility and acceptable use

You must be legally able to enter into a binding agreement to place an order. You may use the Site only for lawful, personal, non-commercial purposes. Do not interfere with the Site, attempt to bypass security measures, use automated means to scrape or overload it, submit false information, or use the Site in a way that infringes another person’s rights.

3. Products, availability, and presentation

Products are offered subject to availability. Images, colors, descriptions, and dimensions are presented as accurately as reasonably possible, but screen settings and made-to-order production can create reasonable variation. We may correct errors, change or discontinue products, or limit quantities at any time.

4. Orders, prices, and payment

Submitting an order is an offer to buy. We may accept, refuse, or cancel an order where permitted by law, including for availability, pricing, suspected fraud, or a clear error. If we cancel a paid order, we will issue any required refund through the original payment method.

Prices are shown in U.S. dollars unless the Site states otherwise. Shipping, applicable taxes, and the final amount are shown before payment. Stripe processes payment through its hosted checkout. By submitting payment information, you represent that you are authorized to use that payment method and authorize the applicable charges.

5. Fulfillment, delivery, and order support

Campagne uses Printful to quote shipping and fulfill made-to-order products. Delivery dates are estimates, not guarantees, and may change due to carrier, production, weather, or other circumstances outside our reasonable control. Please review your shipping information and size before submitting an order. Contact us immediately about a correction; once fulfillment marks the order In Process, it cannot be edited, changed, or canceled.

Because each item is made to order, we do not accept returns or exchanges for a change of mind, a color preference, or an incorrectly selected size. Damaged, defective, misprinted, or incorrect items must be reported within 30 days of delivery. Once an eligible issue is confirmed, Campagne will provide a replacement or refund at no cost to the customer. See Returns & replacements for the reporting process. Nothing in these Terms limits a right or remedy that cannot legally be limited or waived.

6. Product updates

Product updates are optional. A purchase, checkout email, or customer-service communication does not enroll you in marketing. If you subscribe, you can unsubscribe at any time using the link in an update email. Marketing email will include the disclosures and opt-out method required by applicable law.

7. Intellectual property

The Site and its content, including Campagne names, marks, designs, images, text, and product presentation, are owned by Campagne or its licensors and are protected by applicable law. These Terms do not give you permission to copy, reproduce, modify, distribute, display, or commercially use them without prior written permission, except as allowed by law.

8. Third-party services

The Site uses third-party services, including Stripe and Printful. Their services, websites, and policies are governed by their own terms and privacy notices. Campagne is not responsible for third-party services to the extent permitted by law.

9. Disclaimers and limitation of liability

To the fullest extent permitted by law, the Site and products are provided “as is” and “as available,” without warranties other than those expressly stated or required by law. We do not guarantee uninterrupted, error-free, or secure operation of the Site or that every product will be available.

To the fullest extent permitted by law, Campagne will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the Site or an order. Our total liability for a claim relating to a particular order will not exceed the amount you paid for that order. These limitations do not apply where prohibited by law and do not limit liability for fraud, willful misconduct, personal injury, or any liability that cannot lawfully be excluded.

10. Indemnification

To the extent permitted by law, you will indemnify and hold Campagne harmless from claims, losses, and expenses arising from your unlawful use of the Site or your breach of these Terms. This does not require you to indemnify Campagne for our own negligence, misconduct, or legal violations.

11. Governing law and disputes

These Terms are governed by the laws of the State of Tennessee and applicable U.S. federal law, without regard to conflict-of-law rules. Before filing a claim, please contact us so we can try to resolve the issue directly. To the extent permitted by law, any dispute that is not resolved informally must be brought in the state or federal courts located in Tennessee. Nothing in these Terms prevents either party from seeking relief in small-claims court or any forum required by law.

12. Changes, severability, and contact

We may update these Terms by posting a revised version on the Site with a new effective date. If any provision is unenforceable, it will be enforced to the maximum extent permitted and the rest of the Terms will remain in effect. These Terms and the Privacy Policy are the complete agreement between you and Campagne about the Site and purchases, except for terms presented to you at checkout.
